Open Question: how to pass smog check with aftermarket air intake system?

yesterday feb 7, 2012 i went to get a smog check for my mustang 95', but the person inspecting the car said to me that the BBK air intake system was illegal in California, but just recently they became legal because the state of california decided that the intake system did not affect the fuel system.
